An IR35 contract review can hold the key to making sure your contract is compliant and that you’re maximising your tax efficiency. Given the financial implications of working inside IR35 are so significant, we recommend you have your contract reviewed from the outset by an IR35 expert before you start working on a project.

IR35 Contract Review

What Is An IR35 Review?
An IR35 Review is an analysis and compliance check on your written contracts. As we work alongside IR35 partners, one of their IR35 specialists will carry out a thorough clause-by-clause analysis of the written terms and conditions of your contract, before advising on whether they believe it to be ‘inside’ or ‘outside’ the scope of the legislation.
If, for example, your contract is considered ‘inside’ IR35 by their team, specific amendments may be suggested that, if altered, would change the outcome of the review. However, these changes must also then be reflected in your actual working practices when you start your engagement.

Why Do They Matter?
An IR35 contract review is a powerful tool in an IR35 enquiry, demonstrating to HMRC that you have taken steps to determine your status accurately. Because IR35 is such a complex tax, it also reduces the risk of you breaking the rules.
In having your contract professionally reviewed, you also begin to build a stronger case for operating outside IR35 – should that be your aim. Should HMRC ever decide to investigate your IR35 status, having the opinion of an independent expert means you will be well-positioned to challenge the taxman.

Annual IR35 Contract Assessments
Clients on our Assured IR35 or Assured Plus packages have access to an annual IR35 contract assessment by our IR35 partners, which you are encouraged to utilise before entering a new contract.
